Responsibilities of the Legal Affairs Management
The University's Legal Affairs Department, as one of the departments under the esteemed President of the University, fulfills its duties with the mission and responsibility of upholding the rights and protecting the interests of the university. The main duties and authorities of this department are as follows:
1) Litigation (Legal – Criminal)
This involves matters handled by the Legal Affairs Office to uphold the university's rights or defend the university's rights through judicial authorities:
A) Legal Cases:
- Preparing and collecting the necessary documents to draft legal claims or defense briefs, submitting the claim to the judicial authority and registering it, obtaining a registration number and following up, participating in court sessions after setting the time, following up and being informed of the content of the issued rulings for and against the university, and following up on the execution of the ruling, appealing and seeking reconsideration of rulings issued against the university.
- Collecting damages from those who violate the terms of the contract
- Collecting damages from those who refrain from fulfilling their obligations through judicial authorities, notary public offices, or registration offices
- Legal actions to evict property and claim damages, claim arrears
- Enforcement of obligations through various legal means, including judicial authorities, notary public offices, and the Land Registration Office
- Reviewing and responding to legal claims filed against the university in non-judicial authorities
- Reviewing, participating in the sessions of the Administrative Justice Court
- Reviewing, responding to and participating in the sessions of the Administrative Justice Court related to complaints of natural and legal persons against the university and its affiliated institutions
B) Criminal Cases:
- Preparing and collecting the necessary documents and evidence to draft a complaint
- Submitting the complaint to the judicial authority (referral judge), registering it, and obtaining a registration number
- Referring to the referring unit and completing the statement form and creating a case file
- Following up through judicial and law enforcement authorities (interrogation, prosecutor's office, police station, intelligence)
- Introducing a legal representative, participating at the appointed time, and following up until a result is obtained
- Appealing rulings issued against the university
- Following up on the execution of the ruling, final rulings
- Judicial support for employees and officials in judicial authorities
2) Contracts
- Preparing and drafting the tender and auction conditions
- Preparing and drafting the conditions of inquiry
- Preparing and drafting the appendices and attachments of the tender
- Preparing and drafting the contracts required by the affiliated units of the university
- Preparing and drafting addenda and contract amendments based on issued permits
- Reviewing and announcing expert opinions regarding contracts sent from the affiliated units of the university
- Preparing and designing the required forms
- Reviewing the documents and records required to draft the contract
- Preparing and drafting the package and checklist of required services
- Applying corrective comments in the existing packages and checklists
- Registering and recording the concluded contracts in the database regarding the concluded contracts of the university
- Extracting and presenting statistics regarding the concluded contracts of the university
- Posting information related to the university's auctions and tenders on the university website, the National Tender Database, and the website of the Inspectorate General of the Country
- Drafting newspaper advertisements for the university's tenders and auctions
- Archiving related correspondence and files
- Registering statistical information of the held tenders and auctions
- Coordination and planning regarding the opening sessions of the university's tender and auction packages and drafting the commission minutes
- Studying and observing the instructions, circulars, and financial and transactional regulations of the university regarding the drafting of the terms and conditions and the drafted contracts
- Participating in related sessions, conferences, and meetings as instructed by the Head of the Legal Affairs Office
3) Obligations
- Reviewing the status of obligations and obtaining educational compensation from those who have refrained from fulfilling their legal obligations
- Taking the necessary actions regarding the required correspondence in the field of the commitment document and determining the amount of the university's claims from the obligors through the relevant departments and payment sections or the responsible authorities mentioned in the commitment document
- Obtaining an official commitment from individuals who are introduced to this office to take training courses
- Obtaining a commitment for study opportunities
Following up on the documents of those committed to service (medical, nursing, and healthcare students) and those who have defaulted on service, as well as canceling the documents whose commitment has expired
- Supervising and taking action to issue an execution request for enforceable documents in order to collect the rights of the university and the government
- Obtaining a commitment for study opportunities
- Obtaining real and non-real estate collateral from applicants for scholarships
- Taking action to release the document in case of fulfillment of the obligations of the committed person through the relevant notary public and execution of registration until a result is obtained
- In case of non-fulfillment of the obligation, requesting the issuance of an execution order and sending it to the execution of registration to collect the debt
- Corresponding with the employee's guarantor's department for the amount claimed and deducting it from his salary
4) Real Estate Affairs
- Identifying immovable property and endowments, with documents (official, ordinary assignment, reconciliation, ...), without a title deed belonging to the university
- Obtaining information on the university's immovable property from affiliated units on an annual basis to update the statistics and information of the properties
- Obtaining the ownership documents of the university's properties from the affiliated units, to be kept in the Legal Affairs Office and sending the original official ownership documents to the government property department or the provincial treasury
- Referring to the Land Registration and Property Offices, government property, the Islamic Revolution Housing Foundation, Roads and Urban Development, etc., to follow up on the issuance of the university's properties without a title deed
- Guiding and directing the unit liaisons regarding obtaining ownership documents through the aforementioned relevant authorities
- Selling the university's surplus immovable property through the tender procedures after obtaining a sales permit from the university's Board of Trustees and evaluating the property by an expert or a panel of official court experts
- Purchasing the university's required properties in case of allocation of credit and having an approved plan
- Following up on the arrangement and renewal of the lease deed of the university's endowment properties from Astan Quds Razavi and the Endowments and Charity Affairs Organization
- Obtaining the ownership documents of the buildings on properties whose land is an endowment
- Responding and referring to legal and judicial authorities in connection with ownership, possessions, debts, etc., such as courts, Land Registration and Property Offices, the Commission for Documentation of Government Property, the General Department of Government Property, municipalities (Article 77 and 100 Commissions) and other relevant authorities
- Drafting agreements, lease contracts, etc. regarding the transfer of the university's properties to natural and legal persons
- Drafting agreements and memoranda of understanding, etc. regarding properties that are transferred to the university by natural or legal persons
- Responding to inquiries from affiliated units regarding the university's properties
5) Performing Other Assigned Tasks
- Preparing and issuing circulars to inform the university's affiliated units of the provisions of legal regulations, etc.
- Responding to inquiries made by judicial and legal authorities and other public institutions such as municipalities
- Responding to inquiries made by the university's affiliated units
- Responding to complaints from the Labor and Social Affairs Department and participating in the sessions of the Diagnostic Branches, drafting an objection to the rulings issued by the Diagnostic Branches and registering it, participating in the sessions of the Dispute Resolution Branches
- Responding to claims made by the Social Security Organization, drafting an objection to the announced amounts, participating in the sessions of the Primary Board for the Determination of Claims, drafting an objection to the rulings issued by the Primary Board for the Determination of Claims and registering it, participating in the sessions of the Appeals Board for the Determination of Claims
